Have an 8 channel build based upon a BIII and 4 Legatos

Is it feasible to transplant a 9038 into the BIII (along with custom firmware of course) but still use the Legatos?

Yes - that would work just fine.

Thanks Russ - I have the Legato SE output gain resistors set as recommended for 8 channel BIII output - will I have to change them for the ES9038? (if so - to what value would you suggest? Normal stereo operation for BIII?)
